Purchase Terms and Conditions

Your registration with Pony Up Moving Services, LLC ("PUMS") and purchase of our services is subject to the following Purchase Terms and Conditions ("Purchase Terms"), together with our Terms of Use and Privacy Policy.

PLEASE READ THE LISTED PURCHASE TERMS BEFORE REGISTERING OR PURCHASING OUR SERVICES. PLEASE KEEP A COPY OF THESE PURCHASE TERMS FOR YOUR PERSONAL REFERENCE. IF YOU DO NOT AGREE TO THE PURCHASE TERMS STATED, YOU MAY NOT REGISTER WITH THIS WEBSITE OR PURCHASE OUR SERVICES.

Upon booking and payments to purchase our services, you are acknowledging and accepting the following Purchase Terms: There is a $50.00 non-refundable cancellation fee for all College Moves that are booked.

1. Service Description
 

PUMS services consist of facilitating coordinating pickup, shipping, storage and delivery of personal Items using third-party subcontractors selected by PUMS. Subcontractors may include moving companies, delivery companies, and/or storage facilities. PUMS does not have liability for the acts or oversights of these third parties. PUMS does not at any time take possession of your personal Items physically.
 

2. Registration Information
 

In order to hire PUMS and purchase our services, PUMS requires a minimal amount of personal identifying information from each contact form submission request including your name, address, phone number, email address and other basic information. All information that we collect is subject to our Privacy Policy. By registering with the website you are agreeing to the collection and use of your information as disclosed in the Privacy Policy. 
 

PUMS is not responsible for any errors occurring in the information that you submit to PUMS during registration or while placing your orders for services. This includes, with no limitations, any additional fees or misdeliveries that may result from your input errors. You are responsible for checking the information you input for errors before submission for our services.

 

3. Credit Card Information
 

PUMS offers multiple payment methods, including payments made by debit or credit card as well as checks. We accept all major credit cards, however using an American Express card requires a small additional processing fee.
 

All payments and credit card information will be processed through Stripe, our third-party service provider. PUMS does not store your card, expiration date, or card verification value numbers. The credit card used for payment will, however, be kept on file with Stripe. This credit card on file will be used to charge any other service charges or related fees. All purchasing items through our company are standard and written out online and within our contract. You will not be invoiced or receive notification prior to PUMS charging your card on file with Stripe. You may change the form of payment on file by contacting PUMS agents. 
 

In the event that PUMS is unable to process the debit or credit card information you have provided for any reason, you acknowledge that you shall remain indebted to PUMS until the balance owed is submitted by you and successfully received by PUMS. Should you neglect paying the remaining balance due, PUMS reserves the right to retain your personal belongings until payment is received in full. You both acknowledge and understand that delayed payments may cause delays in delivery and possible rescheduling fees in which you will be responsible for that may result from having to reschedule delivery of your Items. Balances for storage services that are not paid within the storage period may result in the holding of the Items as collateral until payment is received. If payment is not received, your belongings will be deemed abandoned and may be auctioned. 
 

If in the event that your items have been delivered and we have no received payment, you are subject to be court ordered to pay remaining charges. Texas Law protects against unpaid labor wages with fines up to over $1,000 or even arrest depending upon cost unpaid.
 

4. Prices and Fees
 

All prices are listed in our shop as well as our online forms. Prices are subject to change without notice. The price listed on the PUMS website on the date and time you place your order is the price that will be locked in place for your service order.

In addition to the prices listed on our website, various fees may apply as described below for changes to services ordered or special arrangements made. You understand and agree to pay PUMS for any of the charges and/or fees that apply to you. These fees are used to compensate PUMS for its additional expenses incurred as a result of the deviation from the standard processes and procedures of PUMS assistance.

 

Upon submission of a college move form, there is a note you acknowledge that additional charges may apply due to PUMS needing to disassemble and/or reassemble anything owned by the client. Any additional time spent during your move can impact the move time of others after you. 

 

If a student makes a scheduling change after May 1st there is a $50.00 rescheduling fee. 
 

When promotional discounts apply, they will be clearly defined as to what items are being discounted. Discounts do not apply to any additional fees or service charges. 
 

Prices listed for storage services are per each four month storage period. Additional storage time is allowed, but additional fees and charges will apply. Additional charges will depend on length of additional stay and quantity of items being stored.
 

If you selected to use a shipping service, any shipping fees will be charged to your card on file with Stripe in addition to the PUMS service charges. Items over 65 lbs may be subject to additional fees set by UPS and other shipping providers. This will be explained in the quote you receive back or upon arrival of services if the large/heavy items are not disclosed before PUMS’s arrival.
 

Accounts with an outstanding balance 30-days from the time of pickup will incur a $50 late payment fee. For each subsequent 30-day period in which the account carries a balance this fee will again be applied. Your Items will be held by PUMS until balance is paid in full.
 

5. Packing and Supplies
 

You are solely responsible for packing boxes. Our website provides packing tips to assist you in packing your boxes; however, it is your responsibility to use your best judgment while packing your items into the boxes.

PUMS offers individual box items and Box Packages to aid in a more convenient move. The boxes/supplies ordered will be delivered to your door, and you will be responsible for packing your items inside. Once your items are packed away, PUMS or UPS member (depending on location) will arrive on your scheduled date and time to retrieve the boxes (and other items previously discussed) and deliver them to your new location, or hold them in our storage facility until your requested move date. You are responsible for obtaining the proper packing supplies and boxes prior to your selected pickup date and time for any PUMS service if you do NOT order boxes and supplies from our company.

 

Each additional box or item that does not fit into a sealed box is a separate "item" for purposes of pricing listed in the PUMS services. All items must fit into the boxes; no protruding/stuffing of items will be accepted. PUMS is not liable for items being broken or damaged during move. Proper packing and safety precautions for our customers belongings is the sole responsibility of our clients.
 

6. Access to Residence Halls
 

PUMS follows and obeys to all terms and conditions of university housing policies as made known to PUMS. While in residence halls PUMS requires you to accompany PUMS representatives at all times. If for any reason access to residence halls is limited to PUMS by university policy, it is your responsibility to arrange a pickup and/or delivery location that PUMS may accommodate. This may require you to bring your Items outside to PUMS representatives. All fees and other terms from this Agreement will still apply for your service regardless of changes made because of university policy.
 

7. Contract Signatures
 

At the time of ordering services, you will be allowed to designate an alternate contact for your order ("Parent/Guardian Contact"). The individual does not need to be the legal Parent/Guardian of the main individual, but this is the option title for there to be any “other” or “alternate” contact for the order and services placed with PUMS. The individual you have named as your alternate contact will be entrusted with your belongings in your absence - for signing, for pick up/delivery, for authorizing the charge, for the services to the credit card on file, and also for confirming the physical state of your belongings upon delivery. Your alternate contact can be changed prior to your service date by contacting PUMS. PUMS is entitled to rely upon the representations made by your alternate contact if the main contact in unavailable. It is not the responsibility of PUMS to work with your selected alternate contact AND contact you. You may not dispute or challenge charges or the physical state of your Items after your alternate contact has approved them. 
 

8. Storage Services 
 

Our storage services require the pick up and delivery of your Items. 

A. Scheduled Pick Ups and Deliveries

When you placing your order for storage, you schedule your preferred pick-up, delivery time and location. 

Pick ups and deliveries scheduled during a PUMS standard move period for a standard PUMS campus location are included within the cost of the PUMS storage services. There are a limited amount of standard moves prearranged per pickup and delivery time slot for each standard move period. Students that select their time slot after this assigned number has been met will need to contact PUMS or select an alternate date/time to complete the services. To avoid these additional peak time fees, schedule your pickups and deliveries as far in advance as possible.
 

You are required to be present at the previously specified pick-up and delivery location during the scheduled time and date of your services. If you will not be present at pick-up or delivery, the alternate contact selected by you must be present while services are being rendered. 
 

If neither you nor your alternate contact is available at the scheduled pickup to provide your Items to PUMS, you may be charged an additional fee for rescheduling your pickup and a small penalty fee may be held as an inconvenience charge by PUMS. At the request of you or your alternate contact, if no one is available to be present at delivery, PUMS may leave your Items outside the scheduled delivery location in which PUMS's responsibility and liability for your items would be terminated at that time. In such an instance, the PUMS representative will sign the delivery form indicating the physical state of the Items as of the time of delivery. This will be the authoritative statement as to the condition of your Items. You agree and acknowledge that PUMS will not be held liable for damage or loss of belongings following delivery by PUMS. PUMS is not responsible for watching or guarding over your items upon completed delivery services.
 

You may reschedule your pickup or delivery time with at least seven (7) days advance notice of the scheduled pickup or delivery time with no additional charges incurred for the rescheduling. Reschedules with less than seven (7) days notice may be charged an additional rescheduling fee. If you reschedule a pick up/delivery time or location with less than two (2) days business notice, PUMC will attempt to accommodate your request but may not be able to do so. 
 

PUMS does not deliver beyond the location agreed upon during Quote Request and Contract signing. If alternate address is needed, please contact PUMC beforehand to let us know of the changes. If new location is equivalent to previously discussed, there may be no additional charge or delay in services. Any additional fees and delays will depend upon any new location requested.
 

B. Storage
 

Your Items will be stored with a third party, climate-controlled storage facility selected at the sole discretion of PUMS. A "climate controlled facility" does not mean the storage facility is air-conditioned. A “climate controlled storage facility” is a storage facility with ventilation that maintains a reasonable temperature for storage of your Items. 
 

Maximum storage period included in storage service pricing for each Item is four (4) months as defined by “summer”, “spring” and “fall”. If you fail to schedule delivery of your Items at least two (2) weeks prior to the end of the 4-month storage period, your payment on file will be charged for an additional four (4) month storage period. 
 

C. Abandonment
 

In the event that a delivery date for your Items is not scheduled and PUMS is unable to charge your credit card for the additional storage period and no other arrangements are made with PUMS for the delivery, pickup, or shipping of your Items, your Items will be deemed abandoned. PUMS reserves the right to assume ownership of any abandoned Items ten (10) days post the last date of the standard delivery period for your storage period. Abandoned Items may be auctioned or otherwise sold.
 

9. Shipping
 

PUMS coordinates shipping services in addition to storage services. We coordinate the shipping of your Items home for the summer semester and also arrange offer shipment of your Items to a storage facility as part of our "Ship to College" services. 

Shipping services may apply to Items scheduled for a new pickup or you may arrange to have any Items shipped that we currently have in storage for you.
 

For shipping services, boxed and sealed Items can be delivered to a local United Parcel Service (UPS) location for shipment. If a pick up is required for any boxed Items for shipping, you may schedule a pickup with UPS through the PUMS website. UPS is solely responsible for any arranged pickups, but PUMS will provide reasonable assistance if requested. Pickup is subject to the same limitations, requirements and potential additional fees as pickup for Items for storage, which are set forth above. 
 

For the Ship to College services, PUMS will accept delivery of Items to the storage facility designated by PUMS. PUMS will receive and inspect the Items for exterior damage sustained during the shipment to the warehouse and will notify you immediately of any damage to the Items.

PUMS acts only as an intermediary for the receipt and forwarding of your shipped Items to UPS. You agree to complete and check the "Ship from" and/or "Ship to" information for errors within the PUMS website when placing your order for shipping services and indicate to the PUMS representative or UPS at the time of pickup which Items are to be shipped. PUMS will transport the Items to UPS as necessary and will process the payment for the shipment to the credit card on file with Stripe.
 

PUMS is not liable for the errors or omissions of any shipping carrier. In the event of damage during shipping, PUMS will however use its reasonable efforts to assist you with any claim against the shipping carrier.

Shipping charges are always additional and these charges are billed extra once the charges are assessed and invoiced from UPS to Pony Up Moving. 

There are not exceptions.

10. Restricted Items
 

PUMS cannot receive, deliver, store or ship any dangerous Items. Upon signing up for our services, you agree that your Items do not and may not consist of any firearms, hazardous, or illegal materials as defined by any federal, state, provincial, or local government in the U.S. Liquid Items or other Items that may impose a risk to you or others’ belongings may not be stored or shipped. In addition, PUMS requests that cash, jewelry, and collectables are not be stored or shipped. 
 

PUMS reserves the right to refuse shipment or storage of any Item that PUMS deems illegal, hazardous, and/or that may otherwise damage equipment or other Items. PUMS reserves the right to open and/or inspect any package submitted for storage or shipping as PUMS or any of its agents or representatives deem necessary.
 

In the event your Items consist any of the above-prohibited Items, you assume all responsibility and liability for such Items and any damages, losses, or fees that result from your failure to adhere to these listed service restrictions. You will pledge and hold PUMS harmless for any damages or liability related to any of your Items. 
 

11. Damaged Items
 

PUMS is not responsible for any items damaged inside of boxes you pack. Items packed inside boxes by the client are of the clients full responsibility. To insure undamaged items. PUMS does not accept unboxed items. All items must be packed into boxes. Any additional boxes needed upon arrival will result in an additional fee. Upon packaging your Items, you agree that the released value of each Item is no greater than the value $100 and that PUMS’s liability on any Item is restricted to $100.
 

PUMS will have no liability to you for any Items that do not have clear indications of physical damage to the exterior. Please note minor scratches or damages on unprotected items are not at the liability of PUMS. To ensure no scratches or damages to your items, please protect accordingly. Unprotected items are not the responsibility of PUMS. PUMS will not be liable for internal damage that is concealed within its outer packaging.
 

Any damaged or lost Items must be reported directly to PUMS within twenty-four (24) hours of service completion. After reporting your loss or damage, you must file a full claim with PUMS within ten (10) days after services have been rendered. Claims not filed within ten (10) days post the scheduled delivery time will be considered waived. All completed claims will be processed by PUMS and a response issued within thirty (30) days from their receipt. Upon approval of the claim, PUMS will disburse the lesser of the following amounts:
 

1. The cost of restoring the Item to its original condition, up to $100
2. The actual replacement value of the Item, up to $100
3. For unboxed Items: $0.60 per pound moved and stored up to $100 for each Item

All damaged Items must be inspected and photographed by a PUMS representative upon delivery in order to properly assess the damage. In the case of loss of your Item, you agree to notify the PUMS representative at the time of delivery of the other Items. The missing Items must be noted on the delivery receipt and signed by the PUMS representative at the time in which the services are rendered. PUMS will not be held responsible for Items reported as damaged or lost after the PUMS representative has left the site.

In the case that you are not present during the delivery, the condition as noted on the delivery confirmation as signed by you, your alternate contact or the PUMS representative will define the existence and extent of the loss or damage.

 

PUMS will have no liability for any damage or loss to the following Items: 

 

1. Cash
2. Coins, jewelry, and collectables
3. Items of intangible or indefinable value
4. Extremely fragile Items (e.g. Glass, mirrors, etc.)
5. Damage to electronic equipment if not packed in its original manufacturer supplied packaging container with no evidence of physical damage or breakage to its packaging container
6. Inadequately packed Items
7. Internal and/or Concealed damage
8. Unpackaged Items, including furniture that is not properly wrapped and protected
9. Minor damage caused by normal handling and moving precautions (including, but not limited to nicks, scratches, & cuts)
10. Damage to outer storage containers (e.g. plastic totes, suitcases, trunks, etc.)
11. Damage due to natural disasters, acts of warfare, acts of terror, or acts of God
12. Damage caused to assembled furniture and/or particleboard
13. Loss or damages occurred while Items are not in the possession of PUMS

 

PUMS’s maximum liability for loss, damage, expense or cost incurred are expressly limited by the terms listed within this Agreement and are limited only to the limited storage period during which Items are in the custody of PUMS.
 

For shipped Items, UPS's damage policy will apply to any Items damaged. Reference UPS's website for their damage policy conditions. Shipping damages or lost Items should be reported directly to UPS or other shipping carrier. PUMS shall have no liability if any claim is denied or only partially paid by the shipping carrier.
 

12. Warranty Disclaimer and Limitation of Liability
 

PUMS is not liable for any consequential, indirect, special, exemplary, or punitive damages resulting from the use of any of its services. All PUMS services are provided "AS IS" and PUMS makes no warranty with admiration to the services or the outcome of using the services. PUMS disclaims any and all warranties, express or implied, with respect to the services including without restriction to any implied warranty of merchantability, fitness for a particular purpose and any warranty arising from a course of dealing or usage in trade. In no event may PUMS’s liability to you or any third party for any loss, harm, expense or cost acquired in excess of the fees paid to PUMS or $100 per Item whichever is greater, even if such remedy should fail of its necessary purpose.  
 

13. Independent Contractors
 

PUMS may use independent contractors and vendors to perform its services. You acknowledge the use of these third parties and understand that you have no contractual agreement with any of these outside parties.
 

14. Affiliation
 

Pony Up Moving Services, LLC is a privately owned limited liability company and is in no way affiliated with or endorsed by any college or university.
 

15. Texas Law
 

Pony Up Moving Services, LLC was founded and is controlled in Dallas, Texas. As such, the laws of the great State of Texas will govern these Purchase Terms. 
 

16. Policy and Compliance
 

Upon registering with us for any of our services, you acknowledge and accept the Purchase Terms stated above. PUMS reserves the right to make changes to their policies, terms, and conditions at any time and will provide notice on our website if we do so.
